Terms and conditions of Connected Realities
§1 GENERAL PROVISIONS
- These Terms and Conditions, provided in a form that allows for their storage, reproduction, and review at any time and place (hereinafter referred to as the “Terms”), set forth the rules governing the operation and use of the website available at www.connectedrealities.eu (the “Service”). The provisions of these Terms constitute the legal basis for the rights and obligations of individuals using the Service (“Users”), except where regulated by mandatory legal provisions. Regarding services provided electronically via the Service, these Terms serve as the regulations referred to in Article 8 of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).
- The administrator of the Service is Connected Realities sp. z o.o., headquartered in Łódź, Poland, at Henryka Sienkiewicza 85/87, Unit 8, 90-057 Łódź. The company is registered in the National Court Register (KRS) under number: 0000838860, VAT ID (NIP): 7252299114, REGON: 386028924 (the “Administrator”). The Administrator can be contacted via email: office@connectedrealities.eu.
- The Service is an online platform that provides, among other things, informational services, such as making VR/AR technology market information available either automatically or upon User request.
§2 RULES FOR USING THE SERVICE AND ITS RESOURCES
- Use of the Service by Users is free of charge, but access to certain resources may require prior registration. To register, the User must have an active email account.
- Accessing the Service requires the User’s IT system to meet the following minimum technical requirements:
- An active internet connection;
- Operating systems: Microsoft Windows XP or later, Linux, OSX 10.4 or later;
- A graphics card supporting a minimum screen resolution of 1024×768;
- The latest versions of browsers: Google Chrome, Mozilla Firefox, Safari, Microsoft Edge, or Microsoft Internet Explorer version 10 or later;
- Installed JAVA JRE 32-bit versions 7 or 8 with valid release dates.
- The Service publishes information on the VR/AR technology market and on services offered by the Administrator. Services provided through the Service include:
- Presenting the Administrator’s service offerings with an option to submit direct inquiries,
- Enabling downloads of informational materials on the VR/AR market,
- Allowing subscription to newsletters, and
- Providing access to a knowledge base within the Service.
- The Service is intended for business Users, including individuals, legal entities, or organizational units without legal personality, using the Service in connection with business or professional activities (not being consumers within the meaning of Article 22 of the Civil Code), and professionally utilizing the content available on the Service.
- Users are obliged to comply with these Terms and refrain from any activities that may disrupt the proper functioning of the Service or its provided services, particularly through the use of unauthorized software or devices.
- Users must also use the Service in a manner consistent with social and ethical norms and applicable legal provisions.
- Use of the Service’s resources by the User does not, under any circumstances, confer any rights to the materials contained therein.
- While the Administrator exercises due diligence in verifying all information available on the Service, such information may deviate from reality. Therefore, the Administrator is not responsible for the accuracy or reliability of the information provided. Users should verify the data on the Service before taking any actions based on it, especially business decisions.
- The Administrator is not responsible for any interruptions in access to the Service’s resources. The Administrator reserves the right to suspend the Service at any time without notifying Users of the reason.
- If a User’s violation of these Terms causes damage to a third party or the Administrator, the User will be required to compensate for such damages.
§3 PERSONAL DATA PROTECTION
- The Administrator of the Service is also the administrator of Users’ personal data. Information on personal data processing and Users’ related rights is available in the Privacy Policy accessible on www.connectedrealities.eu.
§4 ADMINISTRATOR’S LIABILITY
- Subject to provisions that exclude the possibility of limiting liability, particularly Article 473 §2 of the Civil Code, the Administrator is not liable for any actions or decisions made by the User in connection with their use of the Service or for any consequences of using the information obtained through the Service.
- The Administrator is not responsible for independent technical limitations or other disruptions beyond their control that make using the Service impossible or difficult.
- Users utilize the information provided by the Administrator at their own risk and have no claims against the Administrator for using such information, including claims for lost profits or other incidental, consequential, or indirect damages arising from the use of the provided information.
- Users should employ antivirus programs and a firewall (firewall software). These
programs should be kept up-to-date. Users should also use an updated web browser.
§5 EFFECTIVENESS AND AMENDMENTS TO THE TERMS
- The Administrator reserves the right to amend these Terms at any time for the following valid reasons:
- If changes to the Terms are necessary due to amendments to applicable law – as required;
- For security reasons, including to prevent the Service from being used in a manner contrary to legal provisions or these Terms;
- To implement significant changes to the functioning of the Service, including those related to technological advancements affecting the Administrator’s systems;
- Changes to the functionalities, interoperability, and other properties of the digital content provided, including availability, continuity of delivery, and security, insofar as these changes negatively impact access to or use of the digital content.
- The amended Terms will be made available on the Service in a way that allows Users to review them at least 14 days in advance. After this period, the changes become binding.
§6 FINAL PROVISIONS
- For matters related to the functioning of the Service or to file complaints, Users should contact the Administrator via email: office@connectedrealities.eu.
- In matters not regulated by these Terms but related to their content, the provisions of Polish law shall apply.
